The Second Additional District and Sessions Court in Kalaburagi on Thursday sentenced Arun (21) and Santosh (22), residents of Mallabad and Kallahangaraga, in Jevargi taluk, to rigorous life imprisonment and imposed a fine of Rs. 2 lakhs each on them for sexually assaulting a 16-year-old girl. As per details provided by court sources, the convicts had been harassing the girl for some time. One day, Santosh lured the girl with the promise of love and marriage and left her with Arun in a rented room in Kalaburagi. Arun then told her that Santosh’s promise of love and marriage was false and raped her taking advantage of her helpless situation.
Following a complaint lodged by the relatives of the victim, a case was registered in the Jevargi Police Station. Circle Inspector of Police D.B. Patil investigated the case and filed a charge-sheet upholding the claims of the girl and her relatives. After hearing both sides, Gopalappa S, judge, found both Arun and Santosh guilty of crimes specified in the charge-sheet under various sections of Indian Penal Code (IPC) and Sections 4, 6 and 17 of the Protection of Children from Sexual Offences (PoCSO) Act, 2012 and pronounced the punishments and fines. He awarded 10 years rigorous imprisonment and imposed a fine of Rs. 1 lakh each for the crimes specified under IPC Section 366A (procuration of minor girl) read with Section 17 of PoCSO Act and rigorous life imprisonment and a fine of Rs. 1 lakh for the crimes specified under Section 6 of the PoCSO Act. He directed the District Legal Services Authority to pay Rs. 5 lakhs to the victim as compensation. The judge also directed the authorities to pay an additional Rs. 2 lakhs from the fines paid by the convicts.
