CBI officials can check case files: HC

NEW DELHI

The Delhi High Court has allowed CBI Director Alok Verma and Joint Director A.K. Sharma to inspect the case file relating to the FIR against the agency’s Special Director Rakesh Asthana in an alleged bribery case.

Justice Najmi Waziri granted permission to Verma to go to the CVC office on Thursday to inspect the file after his counsel said there are allegations of mala fide against him in Asthana’s petition.

The High Court allowed Sharma to go to the CVC’s office on Friday for inspecting the files.

It further extended its previous order directing the CBI to maintain status quo regarding proceedings against Asthana, who has sought quashing of an FIR against him in a bribery case, till December 7 which is the next date of hearing.

Earlier, counsel for CBI Joint Director Sharma had said he has incriminating evidence against Mr. Asthana and he will place it before the court in a sealed cover.

The court had asked him to instead file the documents before the CBI.

Asthana, in his rejoinder, claimed that the FIR lodged against him was a backlash to complaints of criminal misconduct by the probe agency’s chief. He said that prior approval from the competent authority is mandatory to initiate a probe against a public servant which was not taken in this case.

The CBI has opposed Asthana’s plea seeking quashing of the FIR. The agency said the FIR against  Asthana was registered “on the basis of a complaint received disclosing commission of cognizable offences.”
